      3. You confirm that you are not a person banned from gaming as per the National Database for Restricted Persons (NDRP).
      4. The statement means that you have the complete ability to enter into a legally binding agreement with MegaAraw, and that you are not restricted by any form of legal limitation.

Failure to fulfill these obligations may result in MegaAraw seeking full compensation for all costs associated with the error or incompleteness, including any costs incurred due to the error or incompleteness and the failure to notify the user.
      13. You acknowledge and agree that we are authorized to prohibit or block multiple accounts and have full control over the assets held in such accounts.
      14. You acknowledge and agree that we have the authority to discontinue or modify any games or events available on the Website, as well as to reject or limit bets.
      15. You are required to complete the Know Your Customer (KYC) process upon using vouchers or points within MegaAraw services or prior to your first withdrawal, whichever occurs first. The policy of "No complete KYC, no withdrawal" will be strictly enforced. If we determine that you have provided false or misleading information, we may block or close your user account.

   5. MegaAraw has the right to modify the payout of a bet that has been credited to a user's account, if it is determined by MegaAraw that the payout was made in error.
   6. The amount you win on a bet is calculated by multiplying the stake by the odds at which the bet was placed, and is credited to your account.
   7. You can access a list of all your bets, their current status and details on the Website.
   8. Once a bet has been placed and accepted, it cannot be changed, cancelled or withdrawn by the user.
   9. After the final result is confirmed, your winnings will be paid into your account.

7. Bonuses and Promotions
   1. MegaAraw can cancel any promotion or bonus program immediately if it believes the bonus is set up incorrectly or being abused. If the bonus has already been paid out, MegaAraw can decline any withdrawal request and deduct the amount from your account. The determination of whether a bonus is set up incorrectly or abused is solely at the discretion of MegaAraw.
   2. If you use a Deposit Bonus, you cannot withdraw your original deposit until you meet the requirements outlined in the User Agreement of the Deposit Bonus.
   3. MegaAraw may change, cancel, reclaim or decline any promotion as it sees fit.
   4. If any term of a promotional offer is breached or there is evidence of a group of customers placing a series of bets resulting in guaranteed profits due to a deposit bonus, free bets, or any other promotional offer, MegaAraw reserves the right to reclaim the bonus element of such offers. At their discretion, MegaAraw may either settle bets at the correct odds, void the free bet bonus and risk free bets, or void any bet funded by the deposit bonus. 10. Self-exclusion or Voluntary Termination

1. Introduction:
   1. The MegaAraw Ka-Tama Referral Program ("Program") allows players ("you" "user/s") to earn commissions by referring new players to MegaAraw.
   2. Upon account sign up with MegaAraw ("Company"), a player receives a unique referral QR code that can be used to promote the MegaAraw brand and earn commissions on player referrals.
   3. Registered players can earn commissions through rolling commission, revenue sharing, and a percentage of deposit amounts.
   4. By participating in the Program, you agree to these terms and conditions ("Terms").

2. Definitions· "Referral Ka-TAMA Partner" refers to the registered user of MegaAraw online casino who is promoting the brand using the referral code assigned to their account.

   3. Qualified New User: An individual who has never registered an account with the Company and who signs up using the Referral Partner's unique referral code. A Qualified New User must complete the KYC verification process, and be verified.
   4. Payment Terms: The Company will calculate and pay commissions to the Referral Partner on a [specify frequency, e.g., monthly] basis.
   5. The Company will provide the Referral Partner with detailed reports on the NGR and Tournament Buy-Ins generated by Qualified New Users.
   6. The Company reserves the right to audit the Referral Partner's records to verify the accuracy of the reported data.
   7. Commission payments will be made on a weekly basis depending on the commission scheme and game type played. Commission received on Monday to Sunday will be paid on the following Tuesday.
   8. There is no minimum commission payout.
   9. Commission payments will be made directly to your MegaAraw commission rewards tab found in your profile page which you can swap to cash inside your MegaAraw wallet. These may be withdrawn without any wagering requirements.
   10. In case of a miscalculation of your commission, the Company reserves the right to adjust the amount at any time and promptly settle the underpaid difference, or recover the overpaid balance from the Referral Partner.
   11. Any commission withdrawn is deemed final and full settlement of the commission due for the indicated period.
   12. In case you have any objections to the reported commission due, you must notify the Company within 3 days via email at [email protected] explaining the reasons for the dispute. If the company does not receive any email within the given time period, you may not raise a dispute later on and it will be considered an acknowledgement of the commission due for the given period.
   13. The Company reserves the right to delay the commission due for up to 60 days, pending investigation for any disputed claims.
   14. The Company reserves the right to forfeit any settlement of commission due if any of the terms are violated or if the Company finds probable fraudulent or illegal activity used in acquiring the commission.
   15. The commission shall be deemed inclusive of any applicable taxes.
5. Eligibility:
   
   
   1. To participate in the Program, you must be: at least 21 years old: in the Philippines: not included in the ineligible list: is KYC validated: and a valid MegaAraw account holder. Ineligible Users are not allowed to participate in the Program.
   2. You must be the proprietor of all rights, licenses and permits to market, promote and advertise MegaAraw in accordance with the provisions of this Agreement.
6. Responsibilities of the Referral Partner:
   
   
   1. You shall make every effort to promote and advertise the MegaAraw brand through any legal and ethical means while following the company rules and guidelines published in the website.
   2. You will market and refer potential players at your own expense and will be solely responsible for the content, distribution, and manner of your marketing activities.
   3. You are responsible for the development, operation, and maintenance of your own network, social media postings, digital media space, website and all materials with MegaAraw link, and materials.
   4. You will use only the referral code or link provided by the Referral Partner program, as no guarantee can be given for proper registration and sales accounting otherwise. The Referral Partner will not change or modify any link or marketing material and will not use any of the Company's trademarks, terms, or other intellectual property rights without the Company's prior written authorization.
   5. You will not engage in any conduct that is defamatory, discriminatory, obscene, illegal, or otherwise inappropriate, including any content that contains sexually explicit, pornographic, obscene, or graphically violent materials.
   6. You will not intentionally target individuals who are under the legal age for gambling.
   7. You will not intentionally target any jurisdiction where gambling and its promotion are prohibited by law.
   8. You will not use illegal or fraudulent means to generate traffic to the Company.
   9. You will not create its website in a way that could cause confusion with the Company, or imply that its website is Referral Partnered with or originated from the Company.
   10. You have read and fully comprehend the terms and conditions of this Agreement and agree to abide by them.
   11. You are responsible in checking the terms for any updates as the Company may amend, remove or extend any part of the agreement at any time at its own discretion, without prior notice to the Referral Partner.
7. Responsibilities of the Company
   
   
   1. The Company is responsible in supplying the Referral Partner with all necessary data and promotional resources to enable the implementation of the referral code.
   2. The Company is responsible in managing and keeping records of the commission generated and earned by each referral code.
   3. The Company will provide all relevant statistics and handle any customer service inquiries that arise.
   4. MegaAraw reserves the right to request the removal of any promotional or advertising materials that it deems to be in violation of these Terms.
8. Termination
   
   
   1. Termination of this agreement means closing you MegaAraw account as this agreement is bound with your personal MegaAraw account. This also applies the other way around, if a user decides to close their MegaAraw account then this agreement is also automatically terminated.
   2. Either party may terminate this agreement by providing written notice to the other party, with a notice period of thirty (30) days. Any notice sent via email will be considered a written notice.
   3. The parties involved agree that when this agreement is terminated:
      
      
      a)  The Referral Partner must remove any references to MegaAraw from their marketing channels and communications, regardless of whether they are commercial or non-commercial.

      b)  The Referral Partner's rights and licenses granted under this Agreement will end immediately and any trademarks, service marks, logos, and other designations given to the Referral Partner by the Company will no longer be used.

      c)  The Referral Partner will only be entitled to earned and unpaid commissions up to the date of termination. However, the Company may withhold final payment for a reasonable time to ensure the correct amount is paid. After termination, the Referral Partner will no longer be able to earn or receive commissions.

      d)  If the Company terminates this Agreement due to the Referral Partner's breach, the Company can withhold the Referral Partner's earned but unpaid commissions as collateral for any claim arising from the breach. If the Company terminates the Agreement due to the Referral Partner's breach of any clause in this Agreement, notice period is not required, and the termination is effective immediately.

      e)  The Referral Partner must return any confidential information and its derivatives to the Company.

      f)  The Referral Partner releases the Company from any obligations or liabilities that may arise after the termination, except for obligations that are meant to survive termination. The Referral Partner will still be responsible for any liability that arises from any breach of this Agreement or confidential information that occurred before or after termination. The Referral Partner's obligation of confidentiality towards the Company will survive the termination of this Agreement.
9. Warranties
   
   
   1. The Referral Partner acknowledges that they assume full responsibility for their use of the Internet and that the Referral Partner program is provided without any guarantees or warranties, whether express or implied. The Company does not guarantee that access to its website will be available at any specific time or location.
   2. The Company is not responsible for any inaccuracies, errors, or omissions in the MegaAraw website or Referral Partner program. The Company will not be held liable for any losses, injuries, or damages caused by failures, delays, or interruptions in the website or program.
10. Company rights
    
    
    1. To comply with the company policies and safeguard our interests, the company reserves the right to reject any player or close their account.
    2. If the Referral Partner violates the terms and conditions of this Agreement, as well as the Company's guidelines, policies, and regulations, the Company may take legal measures to protect its interests, in addition to terminating the Referral Partner's account.
11. Assignment The Referral Partner is not allowed to transfer or assign this Agreement, either through legal means or any other way as no user may assign their own account credentials to another person.
    
    
12. Non-waiver
    
    
    1. The Company’s failure to enforce your strict compliance with any provision of the Referral Partner Agreement does not mean that we are waiving our right to enforce that provision or any other provision of the Referral Partner Agreement in the future.
13. Force Majeure
    
    
    1. In the event that any party is unable to fulfill its obligations under the Referral Partner Agreement due to circumstances beyond its reasonable control, such as labor disputes, strikes, acts of God, acts of terrorism, natural disasters, utility or communication failures, or other unforeseeable events, that party shall not be held liable for such delay or failure.
       In the event of such an occurrence, the non-performing party will be excused from performance to the extent prevented by the event.
       However, if the force majeure event continues for a period exceeding thirty (30) calendar days, either party may terminate the Referral Partner Agreement by providing written notice.
14. Relationship of the Parties
    
    
    1. The Company and the Referral Partner are separate entities and the Referral Partner Agreement does not establish a partnership, joint venture, agency, franchise, sales representative or employer-employee relationship between us.
       You do not have the authority to make or accept any offers or representations on our behalf.
       Furthermore, you agree not to make any statements that contradict the provisions of this Referral Partner Agreement, whether on your website or through any other means.
15. Severability/Waiver
    
    
    1. The provisions of this Agreement should be interpreted in a way that is legal and effective, but if any provision is found to be invalid or unenforceable, it will only be ineffective to that extent and the rest of the Agreement will remain valid. No rights can be waived from conduct or failure to enforce them, and any waiver must be in writing to be valid.
16. Confidentiality
    
    
    1. All information, whether it be related to business, finance, customers, pricing, products, records, operations, business plans, processes, trade secrets, market opportunities, or personal data of the Company, must be kept confidential. This includes not using the information for personal gain or sharing it with any third party without explicit and written permission from the Company. This obligation to keep information confidential will continue even after the termination of this Agreement.
17. Trademarks
    
    
    1. The agreement does not give any rights, ownership or interest in the trademarks, trade names, service marks, or other intellectual property rights of the other party. Neither party can attempt to register or challenge the registration of the other party's Marks or any Marks that are similar or confusingly similar to the other party's Marks. This applies during the term of the agreement and even after the termination of this agreement.
